Overview

Welcome to Harleys. Harleys provide their services to you subject to the following conditions. If you visit or shop at Harleys, you accept these conditions. Please read them carefully.

Harleys reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion. By using this website, you agree to comply with and be bound by all of the terms as listed throughout the different sections of this document.

We may change the terms of this agreement from time to time to comply with new laws or codes of practice which are developed. Please check back at this page at any time for any changes.

Definitions

“Harleys”, "we", "our" or "us" refers to Harleys Educational and Stationery Supplies (ABN: 80 011 001 479 ) Trading As Harleys - The Educational Super Store and all entities that represent it: including, but not limited to its online presence at harleyseducational.com.au, or any subdomains.

Freight and Payment Methods

General Information

Please ensure that someone will be available to sign for and take delivery of your parcel. For security reasons, parcels cannot be left at an address where no one is present to take delivery.

Harleys staff will contact you to advise if your goods are not in stock, and need to be placed on special order with the supplier, and the estimated time of arrival. Harleys will confirm if you would like any goods in stock held over until all goods have arrived before arranging delivery.

Harleys does not offer “Cash on Delivery” as a payment method.

Regardless of payment method, full payment (including correct delivery fee) must be received in our account before Harleys will process the order (arrange delivery or place orders for stock with suppliers).

Back to School Deliveries

If you elect to use the Delivery Service, we will send you an sms and an email to let you know that when your pack is complete and ready to be delivered to you via the courier service.

Instore Pickup

When checking out online, Instore pickup is a free option under “Shipping Options”. We will send you an sms and an email to let you know that when your pack is complete and ready. If you would like to Collect and Pay for your Goods at Harleys, you Can Pay by Cash or Cheque, Credit or Eftpos Upon Collection of Your Goods from Harleys.

If you selected shipping by mistake, and come in to pickup the order, Harleys will offer a refund of the delivery fee, if the goods have not yet been sent. We give picking and packing priority to customers utilising the delivery service and your goods are carefully packed to ensure they are not damaged during delivery. If you opt to collect your order from the Harleys store after your goods have been packed for the courier, a $4.00 handling fee per booklist will be deducted from the refund of your delivery fee(s).

Calculated Freight Methods

When placing an order, if you select a shipping method with a calculated amount (e.g. Standard Shipping, etc), you will be able to finalise the transaction with no more to pay. For customers outside the Cairns area, we understand that the cost of freight can become quite expensive, so we endeavour to send goods by the most economical, reliable and efficient means possible, according to the size of your parcel(s), and urgency of delivery. Please advise us if you have an account with a preferred courier.

Uncalculated Freight Methods

When placing an order, if the shipping amount cannot be calculated during checkout, Harleys staff will contact you to advise how much will be required before your order is processed. For Credit Card orders, the security deposit may be charged to your card upon receival of your order. The balance of your order (including delivery costs if applicable) would then be charged at time of dispatch. For non-Credit Card orders, Harleys staff will contact you to advise the amount the Australia Post charges will be so that you can include this in your cheque or money order. Only parcels that have been paid for in full (including correct delivery fee) will be dispatched with the courier service.

Official School or Company 30 Day Account Customers

In most instances, deliveries for schools, daycare centres and kindergartens inside Region 1 will be sent free of charge. If you have an account with a preferred courier, we can enable that as an option in your checkout process.

All government or education department orders must include an official order number, OR government corporate card number (this is a government requirement). Due to government regulations, customers using their government corporate card must also fax a copy of their corporate card order with signature before online orders can be processed.

All schools, kindergartens, daycare centres and businesses must also provide the name of a contact person so there is no delay in getting the goods to the right person as soon as possible. Please state on your order if goods are to be billed to a specific department or account as this will short-circuit any delivery or accounting problems.

Please note, if you place an online order and intend to forward a copy of the official order to Harleys via fax or post, you must CLEARLY state on the order "CONFIRMATION ONLY- ONLINE STORE ORDER" and include your Order Number. Please attach a copy of your online order (if you are able to do so).

Cheque and Money Orders

Cheques and Money Orders are to be made out to “Harleys Educational & Stationery Supplies”. Please provide the following information on the back of any cheques: Name, Address, Phone Number, Drivers Licence Number and Order Number. Please print and include a copy of your online order (if you are able to do so).

Direct Deposit or Electronic Funds Transfer:

To fast track your order, please fax OR email Harleys with the proof of your direct deposit (ie: EFT Receipt Number or Copy of Bank Deposit Slip Butt Stamped By Bank) and make sure that you include your personal details and order number. We can then check our account to confirm your payment has been received.

 

Credit and Return Policy

  • Harleys must be notified of misbound, faulty, incorrectly supplied or short supplied goods within 5 days of delivery.
  • Please choose carefully before purchasing as we do not refund if you simply change your mind.
  • All items are supplied in good faith and are non-returnable unless faulty, misbound or incorrectly supplied. Goods deemed to have a genuine manufacturing fault or defect will be credited or replaced by Harleys, however, original delivery charges cannot be refunded.
  • All Teacher Resource Books and Photocopiable Blackline Masters are FIRM SALE (non returnable) unless misbound or faulty, due to copyright laws. In instances where these blackline masters are misbound or faulty, you will be sent a replacement copy.
  • A "Return Authorisation Number" (RA) must be requested from Harleys prior to goods being returned. Goods returned without an RA will be rejected and returned at your expense. To obtain an RA please contact Harleys. Harleys will assess your request for an RA for your goods and determine whether the return freight will be paid by The Sender (Customer) or Receiver (Harleys).
  • Harleys will fax or email you a label to be pasted on the outside of the carton/parcel as well as paperwork to include inside the parcel with your product. These MUST be included for quick processing of your claim, complete with your original invoice as the proof of purchase. The method of delivery to be used for the return will also be listed on the RA label.
  • If you feel that you have extenuating circumstances for your return that fall outside of the returns policy guidelines above, please contact Harleys management to discuss your claim.

Privacy Policy

The privacy of information you provide to us through accessing this site (your personal information) is important to us. The following privacy statement governs the collection and use of your personal information by Harleys. We have created this privacy statement to demonstrate our firm commitment to protecting the privacy of your information.

When you use this website you consent to collection, use and disclosure of your information as described in this privacy statement.

What Information do we collect?

We collect information from you in the course of providing you with access to some of the services available at or through the site. For example, we receive personal information from you when you use the site to purchase a product.

If we do ask you for information, we will endeavour to say which information that we require and information, which is optional. You may choose not to supply us with information or not to use a particular service if you do not wish to supply any information requested by us.

Our server automatically collects additional information about your use of the site (navigational data). Navigational data includes the type of browser you are using, your IP address, the URL you have come from and the time spent at that URL, cookies and your domain type and server. This kind of information is collected by many sites and used to monitor use of the relevant site.

When you use the Site, cookies may be placed on in the browser file of your harddrive to keep track of your use of the Site and password functions. Cookies do not capture or track any personal information and do not identify any information which they collect. However, you may elect to set your computer so that cookies are not placed on your browser.

Harleys Educational also implements Google Remarketing. Remarketing Data does not contain personally identifiable information.

How do we use your personal information?

We use your personal information to assist us in providing services to you, for example, posting goods to your specified shipping address, or calling you about an issue with an order.

We may also use your personal information for a purpose which is outlined at the time of collecting that personal information, or which can reasonably be inferred from the circumstances in which the personal information is supplied. We may also keep and file all information you send to us.

We use your personal information and navigational data to monitor your use of the Site and improve and develop the Site and the goods and services we offer to you. We rely on your personal information and navigational data to tailor the content we display to you according to your preferences.

We also collect your personal information and navigational data to use for marketing and promotional purposes. If you indicate your acceptance when registering, we will use your personal information and navigational data to contact you about news, updates and services in which we think you may be interested.

Google Remarketing data may be used to advertise to previous website visitors on the Google Display Network including: Google Search, Google Adsense and Youtube.

We may collect information from you in surveys. Survey information which we receive from you will be used to assist us in understanding the demographics and interests of our users. We combine the information you provide us in response to a survey with information received by other survey respondents. We do not personally identify survey information.

We may combine your navigational data with the navigational data of other uses and use the aggregated results to monitor usage of the Site, market to sponsors and advertisers and to improve the Site and our products and services.

Do we disclose your personal information to others?

We may disclose your personal information and navigational data in aggregated form to potential and actual advertisers, sponsors, investors, partners, consultants and advisers. This information and data which we supply will not be identified as your personal information.

We may disclose your personal information to a third party or distributor to enable the delivery of goods or services to you.

Otherwise, we do not disclose personal information, such as your email address, unless we are required to do so by law, regulation, an applicable industry code, for safety reasons or where we reasonably believe that you are in breach of the terms and conditions of use of the Site or are engaged in illegal activities.

Google Remarketing Data is not shared between any third parties other than Harleys Educational and Google.

Your rights to the personal information we hold

You may restrict our use of your personal information.

You can ask us to stop using your personal information to contact you about our products and services. You can ask us to stop using your personal information for direct marketing purposes when we contact you for this purpose. You can ask us to stop passing personal information to third parties.

You can ask us to correct the data we hold. We aim to keep your personal data accurate and error free.

At any time, you may ask us to provide you with a list of the data we hold about you, and copies of that data. We will provide you with the data within 40 days of receiving your request.

If you believe for any reason that we are holding inaccurate data about you, you may ask us to correct it. Your request should specify which data is inaccurate, and what corrections you want us to make. Corrections may also specify data which is incomplete, and the information which is required to update the data. We will make the corrections you ask for within 40 days of receiving your request.

You can ask us to remove the information we hold about you. We will take reasonable steps to destroy or de-identify your personal information. We will comply with your request as far as technically possible and within the limits of our accounting and legal obligations within 40 days.

Trademarks indicated on our site are trademarks of publishers worldwide or its subsidiaries, in Australia and other countries. Harleys store grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Harleys.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Harleys does sell products for children, but it sells them to adults, who can purchase with a credit card. If you are under 18, you may use harleyseducational.com.au only with involvement of a parent or guardian.

Reviews, Comments, Communications, And Other Content

Visitor communication is permitted so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Harleys reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

If you do submit material, and unless we indicate otherwise, you grant Harleys and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Harleys and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose. All items purchased from Harleys are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Harleys makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. you expressly agree that your use of this site is at your sole risk.

From time to time Harleys may promote, or bring awareness to, a competition or promotion being run by one of its suppliers or any other third-party. Facebook Promotions

These promotions are in no way sponsored, endorsed or administered by, or associated with, Facebook. When you enter the draw into any of these promotions you are providing information to Harleys and not to Facebook. Information collected from users during any of these promotions will only be used to provide internal statistics about the promotion, to notify the winners of the competition and to alert users about any upcoming competitions, offers or deals. Booklist Instalment Plan Privacy Statement

Your privacy is important to Harleys Educational Superstore. This statement summarises how we handle your personal information. When you agree to participate in the the booklist instalment plan you agree to the handling of your personal information as set out here.. We will only collect personal information that we require to provide, manage and administer our products and services and to operate an efficient and sustainable business. We may be required to collect certain information from you to comply with state and federal law. We may disclose your personal information to our related entities, and to third parties including government and regulatory bodies and any persons or entities engaged by us or acting on our behalf. We may use your personal information to contact you to advise you of products and services. When you agree to participate in this instalment plan, you consent to us using your personal information to contact you (by phone, email, SMS or post) about products and services that may be of interest to you. If you do not wish to receive this information, you may opt out by contacting us.

 

Booklist Instalment Plan Direct Debit Service Agreement

This agreement outlines the responsibilities of Harleys Educational & Stationery Supplies Pty Ltd (“we”, “us”, “our”) and you. We will confirm the direct debit arrangements prior to the first drawing (including the amounts and frequency) and debit your Visa or Mastercard .  Deductions will occur on the nominated days and dates as per your selection of page 1 of the direct debit application form. A transaction fee of $0.50 will be added to each debit to help cover the cost of the merchant fees that we incur processing your payment.  Should your financial institution dishonour a drawing, we will attempt draw the payment within the next 7 business days. If this debit is also dishonoured we will seek further instructions from you. If this occurs we reserve the right to charge a $2.00 administration fee with the next payment or deduct this from the amount of Booklist credit that you currently hold. If your circumstances change and you need to cancel your entire prepayment plan for a refund, an administration fee of 5% of the value credit will be deducted from your refund.We will maintain the privacy and confidentiality of your billing information (unless you have requested or consented that we can disclose it to a third party or the law requires or allows us to do so). We may provide information to our or your financial institution to resolve a dispute on your behalf. You must ensure your nominated Visa or MasterCard allows direct debiting and that sufficient cleared funds are available in that account on the due date to cover the instalment amount due. Your financial institution may charge a fee if the payment cannot be met. You must ensure the authorisation given to draw on the nominated account is identical to the account signing instruction held by the financial institution where the account is based. You must notify us if the nominated Visa or MasterCard is transferred or closed. You need to advise us of your new credit card expiry date prior to expiry. You may request that we cancel or alter the debit drawing arrangements by contacting us and providing at least five working days notice of any requested changes. These changes may include deferring the debit, altering the debit dates, stopping an individual debit, suspending the direct debit arrangement or cancelling the direct debit completely. You can dispute any debit drawing or terminate the deductions at any time by notifying us in writing not less than seven days before the next scheduled debit drawing. If you have any queries about your direct debit agreement, please contact us. We undertake to respond to queries concerning disputed transactions within five working days of notification.

 

Booklist Prepayment Instalment Plan Details

To participate in this pre-payment plan, the application form must be submitted no later than Friday the 3rd July 2015. Each fortnightly payment (less transaction fees) will be held for you in your ‘customer account’ as an amount of credit. When you place your back to school 2016 booklist order(s) with Harley’s, this credit will be applied against your order. If you have more than one booklist order, the credit will be divided equally against each order, unless you specifically request particular a percentage of the money to be paid against a particular order. All booklist orders must be paid for in full before you can take delivery of the ordered goods. If your instalment plan does not cover the balance of your booklist order(s) the balance of the order must be paid before Harleys Educational Superstore will release the goods.  If your circumstances change and you need to cancel your entire prepayment plan for a refund, an administration fee of 5% of the value credit will be deducted from your refund.

Back To School 2024 Competition

You can enter the "Win Your Back to School Pack Free" promotion on the "Harleys – The Educational Super Store" Facebook Page (www.facebook.com/harleys.educational) between 1st November 2023 and 5.00pm (AEST) on 25th January 2024, and undertaking the promotion requirements.

There is no minimum order spend: any Back to School list order is eligible.

1 winner will be drawn randomly on each of the following dates: 05/01/2024, 12/01/2024 and 19/01/2024. These dates may be altered or changed without notice.

The prize will be the full price of a single Back to School pack from the Order Number that has been drawn; and excludes any other items that were either purchased with the Back to School Pack or in the same purchase as the Back to School Pack. Only one Back to School pack in each wining order can be redeemed: and the winning Back to School pack will be chosen at Harleys Educational's discretion. Goods that were purchased in the winning back to school pack order cannot be returned for refund or credit unless faulty or incorrectly supplied. Only Harleys Educational customers who have purchased a valid Back to School Pack for the 2023/2024 Season are eligible to enter.

The prize is not valid with any other offer. Prize winners will be responsible for collecting all items from the store at 149 English Street, Cairns.

In the event that the prize is not claimed within 3 days of the draw, or the winner is uncontactable: the prize will be awarded to the next applicant that satisfies the above eligibility criteria.

All winners will be drawn by Harleys staff members, at their discretion. This decision is final and can no correspondence will be entered into. The prize winner will be notified by phone number and/or email and will be asked if the winners details can be used in Harleys Educational Promotional Material.

Employees and Directors of Harleys Educational, or agencies associated with the promotion, and their immediate families, are ineligible to enter the promotion. The competition is only open to Australian residents over the age of 18 years.

Harleys Educational accepts no responsibility for any variation in the value of the prize or any variation in the prize advertised and the prize provided. The judges’ decision is final and no correspondence will be entered into. Each entrant releases and indemnifies Harleys Educational against all liability, cost, loss or expense arising out of acceptance of any prize or participation in the promotion including (but not limited to) personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

10% Off Store Wide Sale (Feb 2021) - Terms & Conditions:

  • Sale runs from 5/02/21 until 28/02/21.
  • Goods must be purchased in store only.
  • It will apply to school purchase orders, school corporate card orders and also personal purchases by teachers.
  • Will not apply to goods that need to be ordered in.
  • Will not apply to reading schemes.
  • If goods can't be taken with you on the day, you must spend at least $150 to get free delivery. Free delivery is only available for cairns schools.
